Welcome to Mutual Arrangements, a service of InterGlobal, LLC, (hereinafter referred to as "Mutual Arrangements” or "Site"). Please read and agree to these terms and conditions before you access or view our Site, and read them carefully. By visiting the Mutual Arrangements Site, you are agreeing to its terms. This Agreement is subject to change at any time and changes are effective upon posting. Bookmark this page and check it frequently as it is up to you to refer to this page for any amendments/changes to the original Agreement. . By registering to become a member with Mutual Arrangements you become a member of the service (a "Member") and you agree, without limitation or qualification, to be bound by, and to accept, these Members Terms of Use and Conditions Agreement (the "Terms") and any other posted guidelines or rules applicable for as long as you continue to be a Member. If you do not agree to the Terms, please do not register for the Mutual Arrangements Service or otherwise access or use this Site.

You must be 18 or over to register as a member of or use this Site. Membership in the service is void where prohibited. By using and/or viewing this site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of its terms and conditions, that you are at least 18-years old, and that you are not prohibited by law from using the Site.

Mutual Arrangements has a strict 'no refund' policy. In the event you choose to upgrade to our Premium Member service you agree that you are purchasing the service 'as-is' and understand that Mutual arrangements will not issue full or partial refunds.

You are solely responsible for the content or information you publish or display (hereinafter, "post") on the site, or transmit to other Members of the site. Mutual Arrangements will investigate and take appropriate legal action at its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the site or service and terminating the membership of such violators. You agree that you will not use this site or its services to:

• Intentionally or unintentionally violate any applicable laws and regulations.
• Upload, post, e-mail, otherwise transmit, or post links to any Content that promotes illegal activity, including without limitation the provision of instructions for illegal activity.
• Upload, post, e-mail, or otherwise transmit or post Content to any section of the site including selection of a username or e-mail address that involves cursing, swearing, incest, falsifying gender, violence, necrophilia, impersonating another member or entity, threat of suicide, harm or a threat to oneself or others, pornographic, hateful, defamatory, harassing in nature, violent, libelous, drug paraphernalia, abusive, bestiality, racially, sexually, ethnically, or that is otherwise objectionable.
• Provide instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses; solicit passwords, collect, store, sell or distribute personal identifying information for commercial or unlawful purposes from other users.
• Make any commercial use of data obtained from any Mutual Arrangements database or make any other use of data from any Mutual Arrangements database in a manner which could be expected to offend the person for whom the data is relevant.
• Attempt to solicit or sell any type of products or services to anyone on this site.
• Create multiple memberships or profiles within Mutual Arrangements.
• Upload, post e-mail otherwise transmit or post links to any photographs or other images which displays pornographic or sexually explicit, or nude material of any kind; Mutual Arrangements reserves the right, but has no obligation, to reject any membership, profile, photograph, or image that does not comply with these prohibitions.
• Upload, post, e-mail, otherwise transmit, or post links to any Content that exploits the images of children under 18 years of age, or that discloses personally identifying information belonging to children under 18 years of age.
• Purposely stalk or otherwise act in a harassing nature to any person.
• Conspire to commit any type of illegal activity or crime through the use of this site.
• Upload, post, e-mail, otherwise transmit, or post links to any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam or chain letters," "pyramid schemes," or any other form of solicitation.
• Express or imply that any statements you make are endorsed by us, without our specific prior written consent.
• Harvest or collect personal information about other Members whether or not for commercial purposes, without their express consent.
• Submit an invalid e-mail address for your profile at point of registration or anytime during the term of your membership on this site.
• Use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained herein. You agree that you will not use any device, software or routine to bypass or to interfere or attempt to interfere with the proper working of the Mutual Arrangements. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure.
• Remove any copyright, trademark or other proprietary rights notices contained in the Site.
• Post, distribute or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior consent of the owner of such proprietary rights.
• Interfere with or disrupt the Services or the Site or the servers or networks connected to the Services or the site. Or intentionally disrupt the use of this site by manipulating the hardware, software, or its content.
• Upload, post, e-mail, otherwise transmit or post links to any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or to diminish the quality of, interfere with the performance of, or impair the functionality of the Products and Services of Mutual Arrangements.
• Forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Service.
• Employ misleading e-mail addresses or falsify information in the header, footer, return path, or any part of any communication, including e-mails, transmitted through the Services.
• "Frame" or "mirror" any part of the Site, without our prior written authorization. You also shall not use meta tags or code or other devices containing any reference to Mutual Arrangements or the Service of the Site in order to direct any person to any other website for any purpose.
• Modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Site or any software used on or for the Site or cause others to do so.
• Upload, post, e-mail, or otherwise transmit, or post links to any Content that facilitates hacking.
• Access the Services after your membership or access has been terminated by Mutual Arrangements.
• Advertise, offer for sale, or sell any item you are prohibited from advertising or selling by any applicable local, state, national, or international law, including regulations having the force of law.
• Upload photos which may be at the discretion of Mutual Arrangements confusing as to the correct gender of the user and/or which are uploaded to an account type which do not match the actual gender of that account type.

You are solely responsible for your interactions with other Members. You are responsible for your own privacy and any information you make available through this site. This site is not responsible for the online conversations expressed by the users of this site and does not necessarily agree with any content posted on this site. This site is not responsible for any damage to your hardware/software caused by downloading viruses or any other disruptive data from this site posted by other users. This site is not responsible for any actions taken by you or others in response to any material on this site or contained herein. You acknowledge and agree that Mutual Arrangements and its designees shall have the right (but not the obligation), in their sole discretion, to refuse to publish, remove, or block access to any Content that is available via the Services at any time, for any reason, or for no reason at all, with or without notice. Without limitation, Mutual Arrangements and its designees shall have the right (but not the obligation), in their sole discretion, to refuse to publish, remove, or block access to any Content that violates this Terms of Service Agreement or is otherwise objectionable as determined by Mutual Arrangements, in its sole discretion. Mutual Arrangements may also terminate access to, or membership in, Mutual Arrangements, or any portion thereof, for violating these Terms of Service. You acknowledge and agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by or obtained through the use of Mutual Arrangements and in all other parts of Mutual Arrangements’ Services.

This Mutual Arrangements site is for the personal use of individual members and viewers only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become members of this Mutual Arrangements site and shall not use the Mutual Arrangements service or site for any purpose including but not limited to: sending unsolicited commercial e-mail to members, sending advertisements for other web sites and services, or using member personal identifying information for commercial purposes. Illegal and/or unauthorized uses of the site, including unauthorized framing of or linking to the site or the sending of unsolicited commercial email will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress and/or termination of membership at Mutual Arrangements sole discretion. In order to prevent the sending of unsolicited commercial email messages to its members, Mutual Arrangements may take reasonable steps, including the limiting of the numbers of emails sent or received by a member and electronically filtering or throttling or terminating e-mail messages at Mutual Arrangement’s sole discretion, or hiding the profile of the user in part or wholly from view of other members.

You agree to indemnify and hold Mutual Arrangements its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the service in violation of this Agreement and/or any breach of your representations and warranties set forth above, and/or your infringement of any intellectual property or other right of any person or entity. Mutual Arrangements and its partner sites reserve the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

It is possible that other Mutual Arrangement’s Members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on the Mutual Arrangements service and that you may be involuntarily exposed to such offensive and obscene materials. It is also possible for others to obtain personal information about you due to your use of the Service, and that the recipient may use such information to harass or injure you. Mutual Arrangements is not responsible for the use of any personal information that you may choose to disclose on our Service. Please carefully select the type of information that you post on the services herein or release to others. Mutual Arrangements, reserves the right, without obligation, to monitor the materials posted in all areas of Mutual Arrangements’ Services. Mutual Arrangements reserves the right to remove such material that violates or is alleged to violate, the law or this Agreement. Notwithstanding this right of Mutual Arrangements, every member remains solely responsible for the content of the materials they post in public and private areas of the site, the service, including private messages, messages sent between you and other members which are not readily accessible to the general public will be treated as private by Mutual Arrangements to the extent required by applicable law.

Mutual Arrangements reserves the right to send registered members electronic mail messages regarding its products and services. Mutual Arrangements forwards mail anonymously from other active members to members who have an active membership on our site. You agree to accept such messages.

Mutual Arrangements owns and retains other proprietary rights in the Mutual Arrangements Services and the Site, including data submitted by Members or anonymous users and reserves its right to assign ownership of its data and all property by acquisition of InterGlobal, LLC, its parent company, or its products, jointly or severally, by any third party. The Services and the Site contain the copyrighted material, trademarks and other proprietary information and software of Mutual Arrangements, and its licensors. In addition, other Members may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, publish, transmit, distribute, perform, display or sell any such proprietary information. By posting information or content to any area of Mutual Arrangements, you automatically grant, and you represent and warrant that you have the right to grant, to Mutual Arrangements, and other Members an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing.

Mutual Arrangements, including its officers, directors, agents, subsidiaries and employees is not responsible for any incorrect or inaccurate content posted on the Mutual Arrangements site or in connection with the Mutual Arrangements service, whether caused by users, members or by any of the equipment or programming associated with or utilized in the service, nor for the conduct of any user and/or member of the Mutual Arrangements service whether online or offline. Mutual Arrangements assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user and/or member communications. Mutual Arrangements is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to users and/or members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Mutual Arrangements site and/or in connection with the Mutual Arrangements service. Under no circumstances will Mutual Arrangements be responsible for any loss or damage resulting from anyone's use of the Site or the service and/or any content posted on the Mutual Arrangements site or transmitted to Mutual Arrangements Members. The Site and the service are provided "AS-IS" and Mutual Arrangements expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Mutual Arrangements cannot guarantee and does not promise any specific results from use of the site and/or the Mutual Arrangements service.

Mutual Arrangements and its partner sites reserve the right to modify or discontinue, temporarily or permanently, this site or parts of this site without notice to you. You agree that this site shall not be liable to you or any third party for any modification or discontinuance of this site.

Either you, or Mutual Arrangements, may terminate your membership or use of the site at any time, for any reason, effective upon sending notice to the other party. Mutual Arrangements reserves the right to immediately suspend or terminate your access to the Mutual Arrangements service, without notice, upon any breach of this Agreement by you which is brought to Mutual Arrangements attention.

Except in jurisdictions where such provisions are restricted (and in that event liability is disclaimed to the fullest extent permitted by law), in no event will Mutual Arrangements be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including any liability for death or personal injury due to our negligence, or lost profits arising from your use of the Site or the Mutual Arrangements service, even Mutual Arrangements has been advised of the possibility of such damages. You further agree to hold Mutual Arrangement s, including its officers, directors, agents, subsidiaries and employees harmless for claims arising in the event that another user’s profile ultimately proves to be offensive, harmful, inaccurate and/or deceptive. Notwithstanding anything to the contrary contained herein, Mutual Arrangements’ liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Mutual Arrangements for the service during the term of membership.

Mutual Arrangements does not solicit or control the information provided by other users that is made available through our system. You may find other user's information to be offensive, harmful, inaccurate and/or deceptive. If so, please request a profile review using the link provided on the member’s profile page or at various other places throughout the website. Please also use caution, common sense, and safety when using our site. You are solely responsible for your interactions with other Mutual Arrangements members. Because Mutual Arrangements is not involved in member interactions, in the event that you have a dispute with one or more members or those who have posted, viewed and/or used information on the Mutual Arrangements site, you release Mutual Arrangements, including its officers, directors, agents, subsidiaries and employees, from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." Mutual Arrangements reserves the right, but has no obligation, to monitor disputes between you and other members.

As part of the registration process, you will be asked to select a user name and password. We may refuse to grant any user name or profile handle which impersonates someone else, is or may be illegal, is or may be protected by trademark or other proprietary rights law, is vulgar or otherwise offensive, or may cause confusion, as we determine at our sole discretion. You are responsible for the confidentiality and use of your user name and password and agree not to transfer or resell your use of or access to the Site to any third party. If you have reason to believe that your account is no longer secure, you must promptly change your password by updating your membership information, available within the Site’s services. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USER NAME, AS IT IDENTIFIES YOU AS AN INDIVIDUAL, AND PASSWORD AND FOR ANY AND ALL ACTIVITIES THAT ARE CONDUCTED THROUGH YOUR MEMBERSHIP.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to its conflict of laws provisions. You agree that any legal action or proceeding between you and Mutual Arrangements or its parent company, related to these Terms of Service, shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Broward County in Ft Lauderdale, Florida.

Any and all disputes arising out of or related to these Terms of Use and/or your relationship with Mutual Arrangements and/or your use of this Site shall be submitted to binding arbitration according to the rules of the American Arbitration Association. The parties to the arbitration shall evenly divide any and all costs of the arbitration. Neither party shall be entitled to attorney fees. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Ft. Lauderdale, Florida and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or Mutual Arrangements may seek any interim or preliminary relief from a court of competent jurisdiction in Ft. Lauderdale, Florida necessary to protect the rights or property of you or Mutual Arrangements pending the completion of arbitration.
